FAMILY-BASED IMMIGRATION

Family-Based immigration, also known as “Immediate Relative” immigration, is the fastest way to obtain permanent resident status.

As a U.S. citizen or green card holder, you may sponsor family members for a green card if they are an immediate relative (spouse, minor child, or parent). If your family member is not a close relative, we can help you determine their category. Please note that the following list is only for citizens of the United States.

NATURALIZATION LAWS

Naturalization refers to conferring U.S. citizenship after birth for someone who lacks U.S. citizenship.

The U.S. Constitution gives Congress the power to establish a uniform rule of naturalization. This rule aims to ensure that each new citizen will have sworn allegiance to the United States and its Constitution before becoming a part of our political community. In addition, Congress has made specific requirements for naturalized citizenship because it believes these requirements will help ensure that immigrants become good citizens who contribute positively to American society.

WAIVERS FOR IMMIGRATION

There are four waiver options for immigrants seeking to immigrate to the United States each with certain criteria and limitations.

Immigrants to the United States may apply for a waiver of inadmissibility if they are eligible. If inspected, admitted, or paroled into the U.S. or if a member of a military family unit, you may receive a waiver. Form I-601A requests a waiver of specific grounds of inadmissibility.

Immigrants inadmissible to the United States may apply for a waiver if they are eligible. No other ground of inadmissibility would prevent you from obtaining lawful permanent resident status.

EB-5 IMMIGRANT INVESTOR PROGRAM

EB-5 Immigrant Investor Program is a program that stimulates the U.S. economy through job creation and foreign investment.

The government offers a path to obtain permanent residence by investing in a business in the United States. You must invest in a new or existing U.S. business and create or preserve ten full-time jobs for qualified U.S. workers. You may qualify for immigrant visa classification as an Immigrant Investor under the E-5 program.

ASYLUM LAWS

Asylum claims are by people fleeing their home country and entering or requesting entry into the United States.

To apply for asylum affirmatively or defensively, file Form I-589, Application for Asylum and Withholding of Removal, within one year of your arrival to the United States. You may only file this application if you are physically present in the United States and you are not a U.S. citizen. If you are eligible for asylum, you may be permitted to remain in the United States.

GREEN CARD APPLICATIONS

Green Card holders, known as Lawful Permanent Residents (LPR), are  non-citizens authorized to live permanently in the United States.

You can apply for a Green Card if you are a foreign citizen who is the spouse, unmarried child under the age of 21 of a U.S. citizen, or someone who has political asylum in the United States.

To get a Green Card, you must have passed your interview with an immigration officer and have already waited for one year before returning to your home country for your visa interview.
